Products and price

The current prices of our products are published under www.gartenlounge.ch . Price
changes or price errors are expressly reserved. All prices are net prices, including VAT.
Unless otherwise agreed, offers / offers are subject to prior sale.
The selection made by the customer in the gartenlounge.ch online shop is displayed in
the shopping cart. With the confirmation of the order by the customer, he submits to
gartenlounge.ch a binding offer to conclude a sales contract.  

Delivery conditions

The delivery is carried out in conformity with the selected elements, which are
designated by names. The guarantee for free access to the flat/house or garden is the
responsibility of the buyer.
Delays in delivery due to force majeure or difficulties in procurement do not entitle the
buyer to cancel the order, refuse to accept the ordered items, to claim damages or to
reclaim the purchase price; any liability for any delays in connection with the entire
order and goods delivery processing is rejected.

Payment conditions

Unless otherwise agreed in writing, the products shall be delivered net against advance
payment of the order; other payment options (e.g. cash payment upon delivery, etc.) are
possible by arrangement. In the case of custom-made products, an advance payment of
50% of the invoice amount is to be made. Cash discounts are only permitted if they have
been agreed in writing.
Until payment has been made in full, the purchased items remain the property of AZ
CREATION SA (www.gartenlounge.ch), which is entitled to obtain an entry in the
retention of title register. In the event of default in payment, AZ CREATION SA reserves
the right not to effect delivery or residual delivery of the object of purchase until the
entire remaining purchase price has been paid, or to cancel the purchase agreement for
an administration fee of CHF 500.–
Any counterclaims of the buyer can only be offset with the consent of AZ CREATION SA.

Return policy

The return is at the expense of the customer. Purchase price is only refunded if product
is returned complete, unused and in its original packing. In such cases, gartenlounge.ch
will refund any payment already made after checking the goods

Warranty

The purchaser must inspect the object of purchase upon delivery. Any defects must be
reported in writing within three days. AZ CREATION SA shall not be liable for late
notifications of defects. A possible defect does not entitle the buyer to withhold
payment of the purchase price. Minimal colour differences may occur and must be
accepted by the buyer.
The guarantee for hidden defects is generally two years. The guarantee gives the buyer
a claim to free repair if AZ CREATION SA does not replace the item in question. The
buyer's claims for cancellation and reduction are excluded.
The warranty does not cover breakage of glass and mirrors or damage to the upholstery
cushions caused by wear and tear. Seat mirrors and wrinkles that occur during use are
product-specific, do not constitute a defect and therefore do not give rise to any
warranty claims. Colour and structure differences are natural and are accepted by the
buyer. Excluded from the guarantee are damages caused by wear, ageing, use of other
care and cleaning products and improper handling. The guarantee expires if goods are
further processed or changed by the buyer despite recognizable defects.
The buyer can only claim the guarantee if he has fulfilled his payment obligations.
In the case of a warranty claim, the current value is assumed as it is applied, for
example, to household insurance. The calculation basis for furniture, depending on type
of use and strain, is assumed to be a "life" or "useful life" of 6 to max. 10 years.

product range and its presentation at any time and to remove certain products
completely from the range. We exclude any liability for typographical errors, incorrect
or incomplete information and representations.
We make every effort to ensure the best possible availability of the products offered on
the website. However, the presentation of a particular product on the Website does not
imply that we make any warranty as to its availability. We are only obliged to deliver
goods in stock. If ordered products are not available, we may not be able to complete
the order. We reserve the right to either cancel the order or only make a partial delivery.
In such a case we will inform the buyer accordingly.

Written form

Amendments and/or supplements to these General Terms and Conditions shall only be
valid if made in writing. Oral agreements are only valid if they are confirmed in writing.
